Parents Win Carbon Monoxide Law Suit:

February 5, 2000, St. Cloud, MN- A Jury made a $1.9 million wrongful-death award to a former Stearns County couple whose two children died of carbon monoxide poisoning. The family sued the former owners of the Kimball area home, a real-estate agent and a real estate company after two of their sons, ages 4 and 1, died in their beds in January 1996. The parents and their other son recovered after being hospitalized. The family argued that the deadly gas came from a faulty furnace nobody told them about when they bought the house in August 1995. Named in the lawsuit were the former owners of the home, their agent, and the realty company. A Sterns County jury found the realtor and the realty company, sixty five percent responsible for the children's deaths and the previous home owners thirty five percent responsible. In a criminal trial in November 1998, a jury acquitted the previous home owner on two counts of second-degree manslaughter. He was accused of knowing about the faulty furnace and not telling the new home owners about it.

It's a newer home, what could possibly be wrong?

A family recently moved to a central Minnesota community and purchased a home that was less than two years old from the contractor who built the home. They used all their savings for the down payment. So to save money, and because it was a newer home, they opted not to have the home inspected after they signed the purchase agreement. Eight months later they discovered that the in-floor heating system that was installed in the basement concrete floor was leaking. It turned out that the system was improperly installed and that the wrong type of fluid was used in the system. This family is currently involved in an expensive lawsuit with the contractor whom they bought the home from and they are facing an estimated $9500.00 cost to have the system repaired. Unfortunately, this was not the only problem that they had with this house.

A couple recently signed a purchase agreement to buy a home in central Minnesota and at the last minute decided to have it inspected because it was an older home. The couple fell in love with the home because of its seemingly good condition and its warmth and charm. The inspector noticed that several of the windows were cracked and some of the doors were sticking. To most people this would seem to be a minor problem and a low cost fix. But what actually was causing this problem was that the main wood support beam was badly rotted and needed to be replaced. The seller did not realize there was a problem. Estimated cost to replace the beam and repair the house: $13,500.00!
